These terms explain how website use, bookings, payments, shoots, and delivery work with CONTENCITY.
Using this website
By using this website or submitting a booking request, you agree to these terms. If you do not agree, please do not use the website or book our services.
You must provide accurate contact and project information. You may not misuse the website, interfere with its operation, or use it for unlawful activity.
Bookings and scope
A website submission is a booking request, not a confirmed booking. A shoot is confirmed only after we accept the project, agree on the date and scope, and receive any required deposit.
The confirmed scope may include shoot hours, locations, services, deliverables, editing, turnaround, travel, and any other project requirements agreed in writing.
Pricing and payment
Pricing shown during booking is based on the information selected at that time. Additional hours, locations, travel, edits, rentals, permits, or project changes may change the final price.
Unless we agree otherwise in writing, a 50% deposit confirms the date and the remaining balance is due before final files are released. Invoices and receipts are sent to the billing email you provide.
Payment disputes
If an invoice looks wrong, contact us first and we will review it promptly. Filing a chargeback for services that were delivered as agreed is a breach of these terms. We keep booking records, written communications, and delivery logs, and we may provide them to the payment provider in any dispute.
Changes and cancellations
Tell us at least 24 hours before the scheduled start time if you need to cancel or reschedule. With timely notice, the deposit may be refunded or moved to a new available date.
Late cancellations, missed shoots, substantial delays, or location access problems may result in charges for reserved time and expenses already incurred. Weather, safety, illness, travel disruption, and events outside either party's reasonable control will be handled in good faith.
Client responsibilities
You are responsible for safe and timely access to each location and for obtaining permissions, releases, permits, or approvals needed for the shoot. You are also responsible for identifying any person, location, music, artwork, trademark, or other material that requires permission.
We may pause or end work when conditions are unsafe, unlawful, or materially different from the agreed scope.
Travel bookings
For work outside our local service area, you are responsible for agreed travel expenses such as transportation, lodging, meals, baggage, and local ground travel. Travel arrangements and reimbursements must be approved before the booking is confirmed.
Files, edits, and delivery
Delivery timing and file types depend on the confirmed scope. Same day footage refers to qualifying raw footage and does not guarantee completed edits unless editing and timing are included in writing.
Review delivered files promptly. Requests outside the agreed scope, including additional versions or revisions, may require a new quote. Download links may expire, so you are responsible for storing your delivered files.
Ownership and portfolio use
After full payment, you receive the usage rights described in the confirmed project scope. CONTENCITY retains ownership of its methods, templates, project files, and preexisting materials unless a written agreement says otherwise.
We will not use confidential or unreleased work publicly without permission. Any broader licensing, exclusivity, raw project files, or transfer of copyright must be agreed in writing.
Disclaimers and liability
Creative work is subjective, and we do not guarantee a specific business, audience, platform, or financial result. The website is provided as available without warranties that it will always be uninterrupted or error free.
To the fullest extent permitted by law, CONTENCITY is not liable for indirect, incidental, special, or consequential losses. Our total liability related to a project will not exceed the amount paid for that project.
Mobile messaging
If you separately opt in on our booking form, CONTENCITY may send text messages about your request or project, including quotes, scheduling, reminders, and project updates. Message frequency varies. Message and data rates may apply. Consent to text messages is not a condition of purchasing services.
Reply STOP to stop text messages or HELP for help. After an opt-out, we may send one confirmation that the request was processed. Your wireless carrier is not responsible for delayed or undelivered messages. See our Privacy Policy for how mobile information and consent records are handled.
Indemnification
You agree to defend CONTENCITY and hold it harmless from claims, damages, and costs that arise from material you provide, permissions you were responsible for obtaining, your use of delivered files, or your breach of these terms.
Updates to these terms
We may update these terms when our services, pricing, or legal duties change. Every update to our terms and policies is always reflected on this website, and the effective date at the top of the page shows the latest revision. Continued use of the website or our services after an update means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Florida. Any claim that cannot be resolved informally will be brought in a court with jurisdiction in Miami-Dade County, Florida, unless applicable law requires another location.
Entire agreement
These terms, together with the confirmed project scope and any signed written agreement, are the entire agreement between you and CONTENCITY. If any part of these terms is found unenforceable, the rest stays in effect, and not enforcing a term once is not a waiver of it.
